Terms and Conditions of Sale

These Terms and Conditions of Sale govern the sale of artworks offered by the Gallery:

  • At the physical gallery space in Geneva
  • Through the Gallery’s website
  • Through private sales
  • Through silent auctions or offer-based systems organized by the Gallery

* Any purchase implies full and unconditional acceptance of these Terms and Conditions of Sale.

Hereinafter referred to as “the Gallery”.

Artworks and availability

The proposed artworks are unique pieces, unless otherwise stated for limited editions.

Availability is subject to prior sale. In case of unavailability after order confirmation, the Gallery will inform the customer and propose:

  • A full refund, or
  • An alternative solution agreed upon in writing

Prices

Prices are indicated in Swiss francs (CHF) or in the currency specified on the website.

Unless otherwise stated:

  • VAT is included or excluded according to the applicable regime

  • Shipping, insurance, and transport costs are charged separately

The Gallery reserves the right to modify prices at any time. However, the applicable price shall be the one in force at the time of order confirmation.

Purchase Process

1. Direct Purchase

The sale becomes final upon:

  • Issuing an invoice
  • Receipt of full payment
2. Reservation of an Artwork

An artwork may be reserved upon payment of a deposit agreed in writing.
The reservation is valid only for the period specified by the Gallery. In the event of unjustified withdrawal by the buyer, the deposit may be non-refundable.

 

3. Silent offers/silent auctions

When an offer-based system is implemented:

  • Offers must be made in writing, including via the web form
  • The Gallery reserves the right to accept or refuse any offer
  • The highest accepted offer becomes binding and final
  • Final confirmation is issued in writing

Payment Terms

Payments may be made via:

  • Bank transfer
  • Credit card (if applicable)
  • Cash

The artwork remains the property of the Gallery until full payment has been received.

Delivery and Transport

Delivery may take place:

  • By collection at the Gallery
  • By insured shipment

Deadlines are indicative.

In the case of on-site collection, transport is at the expense and risk of the customer, unless otherwise agreed. The Gallery strongly recommends ensuring any work during transport.

Returns and Refund

1. General Principle

Due to the uniqueness of the works, the sales are firm and final. However, returns can be accepted according to the conditions below.

 

2. Retention in Case of Return

If the Gallery agrees to accept a return:

  • The Gallery shall retain 15% of the amount paid to cover administrative, handling, and logistical costs

  • The remaining 85% shall be refunded after receipt and verification of the artwork’s condition

* The artwork must be returned in perfect condition and in its original or equivalent packaging.

* The return costs are the responsibility of the customer

* Personalized or custom-made artworks are not refundable.

 

3. Discounted items

Artworks purchased at a discounted price, on sale, or as part of a promotional offer are not eligible for return or refund.

 

4. Artworks damaged during transport
  • Damage must be reported within 24 hours of receipt
  • Customer must keep original packaging and provide photos
  • If the transport is organized by the Gallery, the claim will be managed with the insurer
  • If the transport is organized by the customer, the responsibility lies with him
5. Accepted offers and auctions

Any accepted offer is firm and final, without the possibility of cancellation.

Condition of the Artworks

Artworks may present characteristics inherent to the artistic process or, in the case of older works, signs consistent with age.

For online purchases, the condition of the works (including defects and restorations) is always indicated on the product sheet.

Photographs on the website are as accurate as possible, but slight variations in color or perception may exist.

Customers can request additional information before purchase, or make an appointment to see the artwork on site.

Authenticity and Copyright

The Gallery guarantees the authenticity of the artworks sold.

The purchase of an artwork does not transfer any copyright, reproduction rights, or exploitation rights, which remain the property of the artist or their legal successors in accordance with applicable law.

Data Protection

Personal data collected is used exclusively for:

  • Order processing
  • Invoicing
  • Communication with the client

The Gallery complies with applicable Swiss data protection laws.

Liability

The Gallery’s liability is limited to the purchase price of the artwork.

The Gallery shall not be liable for:

  • Damage resulting from improper use of the artwork

  • Damage occurring after delivery

  • Force majeure events

Applicable law and jurisdiction

These Terms and Conditions of Sale are governed by Swiss law.

Any dispute shall fall under the exclusive jurisdiction of the competent courts of Geneva, Switzerland, unless mandatory legal provisions provide otherwise.
